The Digital Services Act is Here - Are You Ready?
The Digital Services Act enters into full force across the European Union on 17 February 2024. So far, it has only applied to certain entities designated as very large online platforms and search engines. However, from 17 February all other service providers within scope must comply with its provisions. Our Technology team sets out the implications for all other service providers within scope who must comply with its provisions from this date.
Preparation
Ireland, as the main EU establishment for many of the world’s largest technology companies, will play an important regulatory role under the DSA and has been busy getting ready for the 17 February deadline.
The Irish President this week signed Ireland’s Digital Services Act 2024 into law. The Act provides Ireland’s main DSA regulators with the necessary supervisory and enforcement powers. On the same day, Ireland’s Digital Services Coordinator, Coimisiún na Meán, published application forms and guidance for Article 21 out-of-court dispute settlement bodies and Article 22 trusted flaggers.
Regulatory activity ramps up
To date, the European Commission has already been active in its regulatory engagement with very large companies. However, from 17 February, we can expect to see a ramp-up in regulatory activity across the board as national regulators enter the picture.
